Government Loses in Court – Again

The government has lost yet another case in the High Court, this time over the cruel lottery of misery they foisted on New Zealand citizens returning that they called MIQ.

The Grounded Kiwis have succeeded in their historic case against the MIQ system.

Justice Jillian Mallon released her decision this afternoon and found that although MIQ was a critical component of the Government’s elimination strategy, the combination of the virtual lobby and narrow emergency criteria meant New Zealanders’ rights to enter their country was infringed.

“In some instances in a manner that was not demonstrably justified in a free and democratic society,” Justice Mallon said.

The decision, which spanned hundreds of pages, outlined Justice Mallon’s decision.

She found that the MIQ system didn’t allow for individual circumstances to be considered and prioritised, and examples of extreme delays were not prioritised.

The MIQ booking system did not allow for individuals, and the prioritisation of returning citizens, due to the “virtual lobby” that operated as a lottery and the criteria for emergency allocation was narrow and too tightly set.

Hundreds of pages telling the government they lost – again.

This is becoming habitual for this Labour Government. At every step, when people challenged the tyrant in court she and her regime lost. Their policies were cruel, immoral and often illegal.

The first lockdown was illegal. The vaccine mandates for Police and Defence Force personnel were “unlawful”, and now the MIQ system has been found to have been “not demonstrably justified in a free and democratic society”.

Former inmates of MIQ surely must have felt it was the weirdest experience in their lives. Two weeks locked up in their own country for doing absolutely nothing wrong. If any have outstanding bills they should just refuse to pay them.

The government ignored health advice, and now their MIQ policies have been found wanting in the courts. Surely there will need to be some compensation, preferably out of the personal pockets of Jacinda Ardern and friends, not the taxpayer.

MIQ was particularly cruel, yet the prime minister, who built her reputation on ‘kindness’, ignored health advice and kept her cruel policies in place.

In the end, the evil of Jacinda Ardern will be remembered at the ballot box.
